Court rejects non-transparent licensing regimes and prohibits enforcement measures

The European Gaming and Betting Association has welcomed a decision by the European Courts that reaffirmed the obligation for Member States to organise a transparent licensing process.

The ruling delivered this morning, found that the closed Hungarian licensing regime to be in violation of the EU Treaty.

The Court of Justice of the EU (CJEU) confirmed the obligation on Member States to organise transparent licensing processes and rejected EU countries’ discretion to impose enforcement measures.

This ruling comes at a crucial time for countries like the Netherlands, were national legislation that has been found incompatible with the Treaties, is enforced.
